{"id":2097,"date":"2020-02-04T14:53:55","date_gmt":"2020-02-04T12:53:55","guid":{"rendered":"https:\/\/ceccararad.ro\/ro\/?p=2097"},"modified":"2020-02-04T14:53:55","modified_gmt":"2020-02-04T12:53:55","slug":"in-atentia-membrilor-ceccar-2","status":"publish","type":"post","link":"https:\/\/ceccarhunedoara.ro\/ro\/in-atentia-membrilor-ceccar-2\/","title":{"rendered":"\u00cen aten\u021bia membrilor CECCAR"},"content":{"rendered":"<section   class=\"fw-main-row  auto  fw-section-position-back\"    >\n\t\t\t<div class=\"fw-container\" >\n\t\t<div class=\"fw-row\">\n\t<div id=\"column-69d5520f40ef8\" class=\"fw-col-sm-12 tf-sh-23c7e74f5178bbd566b649f6fc488228\" >\n\t<div class=\"fw-wrap-col-inner clearfix  \"   >\n\t\t\t\t<div class=\"fw-col-inner\">\n\t\t\t<div class=\"fw-text-box tf-sh-ffbcff31c5466a25686337de2c1b1ad7 \" >\n\t<div class=\"fw-text-inner\">\n\t\t<p class=\"yiv0312795497MsoNormal\"><span lang=\"RO\">V\u0103 reamintim faptul c\u0103 la data de 18 iulie 2019 a fost publicat\u0103 \u00een Monitorul Oficial al Rom\u00e2niei\u00a0<i>Legea nr. 129\/2019 pentru prevenirea \u0219i combaterea sp\u0103l\u0103rii banilor \u0219i finan\u021b\u0103rii terorismului<\/i>\u00a0care abrog\u0103 Legea nr. 656\/2002.<\/span><\/p>\n<p class=\"yiv0312795497MsoNormal\"><span lang=\"RO\">Potrivit prevederilor art.60 (3) din lege, entit\u0103\u0163ile raportoare sunt obligate s\u0103 se conformeze tuturor obliga\u0163iilor ce le revin, \u00een termen de 180 de zile de la data intr\u0103rii \u00een vigoare a legii, respectiv 21 ianuarie 2020.<\/span><\/p>\n<p class=\"yiv0312795497MsoNormal\"><span lang=\"RO\">Intr\u0103 sub inciden\u021ba Legii nr. 129\/2019 entit\u0103\u021bile prev\u0103zute la art. 5 din Legea nr. 129\/2019, respectiv:<\/span><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><em>a)<\/em>\u00a0\u00a0\u00a0\u00a0\u00a0<em>\u201cinstitu\u0163iile de credit persoane juridice rom\u00e2ne \u015fi sucursalele institu\u0163iilor de credit persoane juridice str\u0103ine;<\/em><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><em>b)<\/em>\u00a0\u00a0\u00a0\u00a0\u00a0<em>institu\u0163iile financiare persoane juridice rom\u00e2ne \u015fi sucursalele institu\u0163iilor financiare persoane juridice str\u0103ine;<\/em><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><em>c)<\/em>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<em>administratorii de fonduri de pensii private, \u00een nume propriu \u015fi pentru fondurile de pensii private pe care le administreaz\u0103, cu excep\u0163ia caselor de pensii ocupa\u0163ionale profesionale;<\/em><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><em>d)<\/em>\u00a0\u00a0\u00a0\u00a0\u00a0<em>furnizorii de servicii de jocuri de noroc;<\/em><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><em>e)<\/em>\u00a0\u00a0\u00a0\u00a0\u00a0<em>auditorii, exper\u0163ii contabili \u015fi contabilii autoriza\u0163i, cenzorii, persoanele care acord\u0103 consultan\u0163\u0103 fiscal\u0103, financiar\u0103, de afaceri sau contabil\u0103;<\/em><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><em>f)<\/em>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<em>notarii publici, avoca\u0163ii, executorii judec\u0103tore\u015fti \u015fi alte persoane care exercit\u0103 profesii juridice liberale, \u00een cazul \u00een care acord\u0103 asisten\u0163\u0103 pentru \u00eentocmirea sau perfectarea de opera\u0163iuni pentru clien\u0163ii lor privind cump\u0103rarea ori v\u00e2nzarea de bunuri imobile, ac\u0163iuni sau p\u0103r\u0163i sociale ori elemente ale fondului de comer\u0163, administrarea instrumentelor financiare, valorilor mobiliare sau a altor bunuri ale clien\u0163ilor, opera\u0163iuni sau tranzac\u0163ii care implic\u0103 o sum\u0103 de bani sau un transfer de proprietate, constituirea sau administrarea de conturi bancare, de economii ori de instrumente financiare, organizarea procesului de subscriere a aporturilor necesare constituirii, func\u0163ion\u0103rii sau administr\u0103rii unei societ\u0103\u0163i; constituirea, administrarea ori conducerea unor astfel de societ\u0103\u0163i, organismelor de plasament colectiv \u00een valori mobiliare sau a altor structuri similare, precum \u015fi \u00een cazul \u00een care particip\u0103 \u00een numele sau pentru clien\u0163ii lor \u00een orice opera\u0163iune cu caracter financiar ori viz\u00e2nd bunuri imobile;<\/em><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><em>g)<\/em>\u00a0\u00a0\u00a0\u00a0\u00a0<em>furnizorii de servicii pentru societ\u0103\u0163i sau fiducii, al\u0163ii dec\u00e2t cei prev\u0103zu\u0163i la lit. e) \u015fi f);<\/em><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><em>h)<\/em>\u00a0\u00a0\u00a0\u00a0\u00a0<em>agen\u0163ii imobiliari;<\/em><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><em>i)<\/em>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<em>alte entit\u0103\u0163i \u015fi persoane fizice care comercializeaz\u0103, \u00een calitate de profesioni\u015fti, bunuri sau presteaz\u0103 servicii, \u00een m\u0103sura \u00een care efectueaz\u0103 tranzac\u0163ii \u00een numerar a c\u0103ror limit\u0103 minim\u0103 reprezint\u0103 echivalentul \u00een lei a 10.000 euro, indiferent dac\u0103 tranzac\u0163ia se execut\u0103 printr-o singur\u0103 opera\u0163iune sau prin mai multe opera\u0163iuni care au o leg\u0103tur\u0103 \u00eentre ele.<\/em><\/p>\n<p class=\"yiv0312795497MsoNormal\"><i><span lang=\"RO\">\u00a0\u00a0\u00a0 (2) F\u0103r\u0103 a aduce atingere dispozi\u0163iilor alin. (1), agen\u0163ii \u015fi distribuitorii institu\u0163iilor emitente de moned\u0103 electronic\u0103 \u015fi institu\u0163iilor de plat\u0103, inclusiv cei ai institu\u0163iilor din alte state membre care presteaz\u0103 servicii pe teritoriul Rom\u00e2niei ori punctul central de contact, dup\u0103 caz, respect\u0103 obliga\u0163iile legale \u00een materie de prevenire \u015fi combatere a sp\u0103l\u0103rii banilor \u015fi a finan\u0163\u0103rii terorismului.<\/span><\/i><\/p>\n<p class=\"yiv0312795497MsoNormal\"><i><span lang=\"RO\">\u00a0\u00a0\u00a0 (3) \u00cen aplicarea alin. (2), institu\u0163iile emitente de moned\u0103 electronic\u0103 \u015fi institu\u0163iile de plat\u0103 le impun contractual agen\u0163ilor \u015fi distribuitorilor prin care presteaz\u0103 servicii pe teritoriul Rom\u00e2niei conformarea la prevederile din prezenta lege \u015fi din reglement\u0103rile emise \u00een aplicarea acesteia \u015fi stabilesc mecanismele de conformare<\/span><\/i><span lang=\"RO\">\u201d.\u00a0<\/span><\/p>\n<p class=\"yiv0312795497MsoNormal\"><span lang=\"FR\">Printre cele mai importante obliga\u021bii instituite de noul act normativ, se num\u0103r\u0103:<br \/><b>1. Obligatia desemnarii persoanelor cu responsabilit\u0103\u021bi \u00een aplicarea Legii nr. 129\/2019<\/b><br \/>Conform art. 23 entitatile raportoare au obliga\u021bia de a desemna una sau mai multe astfel de persoane, cu precizarea naturii si limitelor responsabilitatilor \u00eencredintate, ale caror nume vor fi comunicate Oficiului Na\u021bional de Prevenire si Combatere a Spalarii Banilor.<\/span><\/p>\n<p class=\"yiv0312795497MsoNormal\"><span lang=\"FR\">Sunt exceptate de la desemnare si comunicare persoanele fizice care au calitatea de entitate raportoare, precum si entitatile raportoare prevazute la art. 5 lit. i).<\/span><\/p>\n<p class=\"yiv0312795497MsoNormal\"><span lang=\"FR\">Persoanele prev\u0103zute la art. 5 lit. i) au obliga\u021biile legale (de raportare numerar, de identificare a clientelei, de intocmire norme \u0219i politic interne etc) cu privire la respectivele opera\u021biuni, f\u0103r\u0103 a desemna o persoan\u0103.<\/span><\/p>\n<p class=\"yiv0312795497MsoNormal\"><span lang=\"FR\">Persoanele care nu se regasesc \u00een lista exhaustiva de la art. 5 din lege nu au nicio obliga\u021bie referitor la acest domeniu.<\/span><\/p>\n<p class=\"yiv0312795497MsoNormal\"><span lang=\"FR\">Ne\u00eendeplinirea obliga\u021biei de desemnare atrage o amenda de la 25.000 lei la 150.000 lei pentru persoanele fizice, in timp ce pentru persoanele juridice, amenzii de mai sus i se adauga 10% din veniturile totale raportate la perioada fiscala incheiata, anterioara datei intocmirii procesului-verbal de constatare si sanctionare a contraventiei.<\/span><\/p>\n<p class=\"yiv0312795497MsoNormal\"><span lang=\"RO\">Desemnarea unei persoane \u00een rela\u021bia cu Oficiul, obliga\u021bie prev\u0103zut\u0103 la art. 23 alin. (1) din Legea nr. 129\/2019, se realizeaz\u0103 exclusiv \u00een format electronic, prin accesarea site-ului institu\u021biei \u2013 rubrica \u201d<i>Desemnare persoan\u0103 \u0219i raportare on-line<\/i>\u201d \u2013 subrubrica \u201d<i>Desemnare persoan\u0103 \u0219i raportare on-line<\/i>\u201d \u0219i parcurgerea etapelor \u00een vederea ob\u021binerii unui cont \u00een Sistemul Electronic de Transmisie Date (SETD).<\/span><\/p>\n<p class=\"yiv0312795497MsoNormal\"><span lang=\"RO\">Pentru entit\u0103\u021bile raportoare care au desemnat una sau mai multe persoane \u00een rela\u021bia cu Oficiul \u00eenaintea intr\u0103rii \u00een vigoare a Legii nr. 129\/2019 sau nu mai au dovada transmiterii documentului privind desemnarea persoanei, se recomand\u0103 retransmiterea informa\u021biilor \u00een temeiul Legii nr. 129\/2019, exclusiv \u00een format electronic, prin parcurgerea etapelor \u00een vederea ob\u021binerii unui cont \u00een Sistemul Electronic de Transmisie Date (SETD).\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><\/p>\n<p class=\"yiv0312795497MsoNormal\"><span lang=\"RO\">Obliga\u021bia prev\u0103zut\u0103 la art. 23 alin. (1) din Legea nr. 129\/2019, de desemnare a unei persoane \u00een rela\u021bia cu Oficiul, trebuie \u00eendeplinit\u0103 de \u00eens\u0103\u0219i entitatea c\u0103reia \u00eei revine respectiva obliga\u021bie.<\/span><\/p>\n<p class=\"yiv0312795497MsoNormal\"><b>2. Declararea beneficiarului real al persoanelor juridice<\/b><\/p>\n<p class=\"yiv0312795497MsoNormal\">Societ\u0103\u021bile supuse obliga\u021biei de \u00eenregistrare la Registrul Comertului trebuie s\u0103 depun\u0103 o declaratie pe proprie raspundere privind beneficiarul real al persoanei juridice.\u00a0<span lang=\"FR\">Declaratia se depune in 15 zile de la aprobarea situatiilor financiare anuale sau in 15 zile de la aparitia oricarei modificari privind datele de identificare ale beneficiarului real.<\/span><\/p>\n<p class=\"yiv0312795497MsoNormal\"><span lang=\"FR\">Primul termen pentru depunerea acestei declaratii este 21 iulie 2020, iar sanctiunea pentru nerespectatea obligatiei poate ajunge la 10.000 lei si dizolvarea societatii.<br \/><b>3. Obliga\u021bia de raportare catre Oficiul National de Prevenire si Combatere a Spalarii Banilor<\/b><\/span><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><span lang=\"RO\">\u00b7<\/span><span lang=\"RO\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span>Obligatia de raportare a tranzactiilor suspecte (art. 6);<\/p>\n<p class=\"yiv0312795497MsoNormal\"><span lang=\"FR\">\u00b7<\/span><span lang=\"FR\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><span lang=\"FR\">Obliga\u021bia de raportare a unor tranzac\u021bii care nu prezint\u0103 indicatori de suspiciune (art. 7), respectiv :<\/span><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><span lang=\"RO\">\u2013<\/span><span lang=\"RO\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><span lang=\"RO\">raportarea tranzac\u0163iilor cu sume \u00een numerar, \u00een lei sau \u00een valut\u0103, a c\u0103ror limit\u0103 minim\u0103 reprezint\u0103 echivalentul \u00een lei a 10.000 euro;<\/span><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><span lang=\"RO\">\u2013<\/span><span lang=\"RO\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><span lang=\"RO\">raportarea transferurilor externe \u00een \u015fi din conturi, \u00een lei sau \u00een valut\u0103, a c\u0103ror limit\u0103 minim\u0103 reprezint\u0103 echivalentul \u00een lei a 15.000 euro, realizat\u0103 exclusiv de c\u0103tre institu\u0163iile de credit \u015fi institu\u0163iile financiare definite conform legii;<\/span><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><span lang=\"RO\">\u2013<\/span><span lang=\"RO\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><span lang=\"RO\">raportarea transferurilor de fonduri a c\u0103ror limit\u0103 minim\u0103 reprezint\u0103 echivalentul \u00een lei a 2.000 euro, realizat\u0103 exclusiv de c\u0103tre entit\u0103\u021bile prin intermediul c\u0103rora se realizeaz\u0103 activitatea de remitere de bani.\u00a0<\/span><\/p>\n<p class=\"yiv0312795497MsoNormal\"><span lang=\"RO\">Raportarea tranzac\u021biilor cu sume \u00een numerar, \u00een lei sau \u00een valut\u0103, a c\u0103ror limit\u0103 minim\u0103 reprezint\u0103 echivalentul \u00een lei a 10.000 euro, nu exclude \u0219i raportarea acestora ca tranzac\u021bii suspecte, dac\u0103 exist\u0103 indicatori de suspiciune, conform art. 6 din lege.<\/span><\/p>\n<p class=\"yiv0312795497MsoNormal\"><span lang=\"RO\">Raportarea c\u0103tre Oficiu a tranzac\u0163iilor cu sume \u00een numerar, \u00een lei sau \u00een valut\u0103, a c\u0103ror limit\u0103 minim\u0103 reprezint\u0103 echivalentul \u00een lei a 10.000 euro, efectuate de c\u0103tre clien\u021bii entit\u0103\u0163ilor men\u021bionate la art. 5 alin.(1) lit. e) din Legea nr. 129\/2019, revine clien\u021bilor \u00een\u0219i\u0219i \u0219i nu expertului contabil, contabilului autorizat, care \u00eei acord\u0103 consultan\u021b\u0103 contabil\u0103, fiscal\u0103, financiar\u0103 sau de afaceri.<\/span><\/p>\n<p class=\"yiv0312795497MsoNormal\"><span lang=\"RO\">\u00cen situa\u021bia \u00een care, din verific\u0103rile realizate cu privire la activit\u0103\u021bile clien\u021bilor proprii, rezult\u0103 indicatori de suspiciune conform art. 6 din lege, entit\u0103\u0163ile men\u021bionate la art. 5 alin.(1) lit. e) din Legea nr. 129\/2019 au obliga\u021bia transmiterii unui raport de tranzac\u021bii suspecte.<\/span><\/p>\n<p class=\"yiv0312795497MsoNormal\"><b><span lang=\"RO\">3. Obliga\u021bia de stabilire a politicilor, normelor interne, mecanismelor de control intern \u0219i a procedurilor de administrare a riscurilor de sp\u0103lare a banilor<\/span><\/b><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><span lang=\"RO\">\u2013<\/span><span lang=\"RO\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span>Obliga\u021bii decurgand din procedura raportarii (art. 8-9);<\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><span lang=\"RO\">\u2013<\/span><span lang=\"RO\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><span lang=\"FR\">Obliga\u021bia de a aplica masurile de cunoastere a clientelei<\/span><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><span lang=\"RO\">\u2013<\/span><span lang=\"RO\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span>Obliga\u021bii decurgand din utilizarea unor terte parti (art. 18);<\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><span lang=\"RO\">\u2013<\/span><span lang=\"RO\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span>Obliga\u021bia de a tine evidenta documentata a masurilor luate in vederea identificarii beneficiarilor reali (19);<\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><span lang=\"RO\">\u2013<\/span><span lang=\"RO\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span>Obliga\u021bia pastrarii documentelor care atesta aplicarea procedurilor de cunoastere a clientelei (art. 21);<\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><span lang=\"RO\">\u2013<\/span><span lang=\"RO\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span>Obliga\u021bia identificarii si evaluarii riscurilor (art. 25);<\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><span lang=\"RO\">\u2013<\/span><span lang=\"RO\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><span lang=\"FR\">Obliga\u021bia de a comunica Oficiului datele si informatiile necesare indeplinirii atributiilor prevazute de lege (art. 26).<\/span><\/p>\n<p class=\"yiv0312795497MsoNormal\"><span lang=\"FR\">Concret, trebuie elaborate \u0219i puse efectiv \u00een aplicare, de c\u0103tre toate entit\u0103tile raportoare prev\u0103zute la art. 5 lit. e), m\u0103suri:<\/span><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><span lang=\"FR\">\u2022<\/span><span lang=\"FR\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><span lang=\"FR\">\u00een materie de cunoastere a clientelei;<\/span><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><span lang=\"FR\">\u2022<\/span><span lang=\"FR\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><span lang=\"FR\">\u00een materie de raportare, pastrare a evidentelor si a tuturor documentelor conform cerintelor din prezenta lege si de furnizare prompta a datelor la solicitarea autoritatilor competente;<\/span><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><span lang=\"FR\">\u2022<\/span><span lang=\"FR\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><span lang=\"FR\">\u00een materie de control intern, evaluare si gestionare a riscurilor, managementul de conformitate si comunicare;<\/span><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><span lang=\"FR\">\u2022<\/span><span lang=\"FR\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><span lang=\"FR\">\u00een materie de protectie a personalului propriu implicat in procesul de aplicare a acestor politici, impotriva oricaror amenintari ori actiuni ostile sau discriminatorii;<\/span><\/p>\n<p class=\"yiv0312795497MsoNormalCxSpMiddle\"><span lang=\"FR\">\u2022<\/span><span lang=\"FR\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><span lang=\"FR\">de instruire si evaluare periodica a angajatilor.<\/span><\/p>\n<p class=\"yiv0312795497MsoNormal\"><span lang=\"RO\">Conform Legii nr. 656\/2002 obliga\u021bia de \u00eentocmire a politicilor \u0219i normelor \u00een materia prevenirii \u0219i combaterii sp\u0103l\u0103rii banilor \u0219i a finan\u021b\u0103rii terorismului revenea organismului de autoreglementare (art 20 alin. 2).\u00a0 \u00cen prezent toate entit\u0103\u021bile raportoare de la art. 5 lit. e) au obliga\u021bia de a \u00eentocmi aceste norme personal, indiferent dac\u0103 au sau nu personalitate juridic\u0103 (art 24 din Legea nr. 129\/2019).<\/span><\/p>\n<p class=\"yiv0312795497MsoNormal\"><span lang=\"RO\">Conform art. 59 alin.
